These Terms of Service apply to purchases made from Annalise Paints through www.annalisepaints.com.
By accessing our website or purchasing from Annalise Paints, you agree to these Terms of Service.
Products
We make every effort to display our products, artwork and colours as accurately as possible. Colours may vary slightly depending on your screen, lighting, printing processes or the handmade nature of a product.
Many Annalise Paints products are handmade, hand-painted or created in small quantities. Small variations are part of the nature of handmade work and are not considered defects.
Orders and Payments
All prices are displayed in Australian dollars unless otherwise stated.
Orders are subject to availability and are not confirmed until payment has been successfully processed.
We reserve the right to cancel or refund an order where a product is unavailable, an incorrect price has been displayed, fraudulent activity is suspected or we are otherwise unable to fulfil the order.
Custom Pet Portraits
Custom pet portrait places are limited and released in collections.
A $50 deposit is required to reserve each pet commission. The deposit is credited towards the final price of your portrait.
The deposit is non-refundable for change of mind because your booking reserves a limited position in the painting queue. If your plans change, your deposit may be transferred to a future portrait collection.
Portrait timeframes are estimates and may vary depending on workload, communication, reference photograph suitability and other circumstances. Where a specific collection timeframe is advertised, we will make reasonable efforts to complete your artwork within that timeframe.
Reference Photographs
By submitting a photograph for use in a custom portrait, you confirm that you own the photograph or have permission from the copyright owner to provide it to Annalise Paints for the purpose of creating your commissioned artwork.
You grant Annalise Paints permission to use the supplied photograph solely as required to create your commissioned artwork and communicate with you about your order.
Artwork Copyright
Purchasing an original artwork gives you ownership of the physical artwork.
Unless otherwise agreed in writing, copyright and intellectual property rights in artwork created by Annalise Paints remain with Annalise Paints.
Artwork may not be commercially reproduced, copied, altered, sold as a reproduction or used for commercial purposes without prior written permission.
Copyright protection for original artistic works arises automatically in Australia, and IP rights can be licensed or transferred separately from ownership of the physical item.
Sharing Completed Portraits
Annalise Paints may photograph completed artwork for portfolio, website, social media and promotional purposes.
If you would prefer your commissioned portrait to remain private, please contact us before your portrait is completed and we will happily honour your request.
Shipping
Shipping prices, processing times and delivery estimates are outlined in our Shipping Policy.
Delivery estimates are provided as a guide and may be affected by circumstances outside our control.
Returns and Refunds
Returns, refunds, exchanges and cancellations are handled in accordance with our Refund Policy and Australian Consumer Law.
Nothing in these Terms is intended to exclude or limit rights that cannot legally be excluded under Australian Consumer Law.
Website Content
All artwork, illustrations, photographs, graphics, branding, product designs and written content displayed on the Annalise Paints website remain the property of Annalise Paints or their respective rights holders.
Content may not be reproduced or used commercially without written permission.
Changes to These Terms
We may update these Terms of Service from time to time. The version published on our website at the time of purchase will apply to your order, subject to applicable law.
